Terms of Service

These Terms of Service (“Terms”) apply to purchases, bookings, and use of Rootd Modular Homes’ digital products, workshops (in-person or virtual), invoices, and payment links (“Services”). By purchasing or using our Services, you agree to these Terms.

1) Who we are

Rootd Modular Homes (“Rootd,” “we,” “us”) provides educational content, workshops, and digital products related to housing, planning, and related topics.

2) Purchases and payment

Payments may be processed through Stripe (including Stripe Checkout, invoices, or payment links). By paying, you confirm you are authorized to use the payment method.

Prices may change over time, but changes won’t affect completed purchases.

3) Workshops (in-person or virtual)

Registration: The ADU Planning Workshop is currently offered free of charge and is booked one household per session. Members of the same household are welcome to attend together. A session is not held until you receive a booking confirmation by email. Sessions are worked around the free ADU Feasibility Address Check for your property, and we ask that you run it before the session so there is something specific to work from.

Event details: Workshop format, location, schedule, or instructors may change. If changes are significant, we’ll notify registrants by email.

Conduct: We expect respectful behavior. We may refuse service or remove participants for disruptive, harassing, or unsafe behavior without a refund.

4) Digital products

Digital products may include downloads, templates, videos, or other materials.

License: Unless stated otherwise, purchases grant a personal, non-transferable license for your own use. You may not resell, redistribute, or publish the materials.

5) Site scans and hosting

Rootd owns the 3D scan model of your property and hosts it on its own account. You receive a viewing link you may share with anyone you choose, and a collaborator link for your designer, builder or family on request.

Hosting: your model is hosted free for 90 days from your Scoping Visit. After that you can keep it live for an annual hosting fee (currently $99 a year), or it stays up at no cost for as long as you have an active project with Rootd. If hosting is not extended, you get 14 days’ notice before the space is archived.

Archiving and restoring: an archived scan can be restored on request for 12 months from the date it was archived. After that window we cannot guarantee restoration.

Use of the scan: Rootd uses your scan to produce your own deliverables. Any other use, including marketing or demonstration of method, requires your written permission.

What the scan is not: a 3D scan records visible, above-ground conditions. It is not a boundary survey, not a septic judgment, and not survey-grade data. Accuracy is approximately plus or minus 20mm at 10m per the manufacturer’s published spec.

6) Introductions and referral fees

Rootd may introduce or recommend a builder, designer, factory or other professional. Rootd ranks no firm and does not act as your agent in selecting one. The choice is yours, and you are under no obligation to engage anyone Rootd puts in front of you.

Compensation: where Rootd introduces or recommends a firm and you enter into a contract with them, Rootd may receive a fee from that firm. Any such fee is flat, set per type of professional, identical for every firm of that type, and does not vary with the value or scope of your project. Rootd will disclose any such arrangement before you make a decision that relies on it.

Scan data: Rootd retains ownership of the scan model. A firm given access receives it for your project only, and may not use it for marketing or any external purpose without written consent from you and from Rootd.

Rootd is an independent consultant. Rootd is not a party to any agreement between you and a firm it introduces, does not direct or control that firm's work, and holds no fabrication, construction or brokerage contract.

7) Refunds and cancellations

Refund eligibility depends on what you bought:

Workshops

The ADU Planning Workshop is currently free, so there is nothing to refund. Cancel or reschedule from your booking confirmation. The terms below apply to any paid session.

Digital products

Digital products are non-refundable once accessed or downloaded, unless required by law.

Add-on deliverables

Add-on deliverables (measured floor plans, property record files) are non-refundable once delivered.

Site Feasibility Study outside the service area

The Site Feasibility Study covers Ulster County, New York. If you purchase a Study for a parcel outside that area, we refund you in full rather than take the work.

8) Professional advice

A. Workshops (Educational)

Workshop content is educational and general in nature. It isn’t legal, financial, engineering, or architectural advice, and it shouldn’t be used as a substitute for consulting licensed professionals or local authorities. Workshop content may include planning, zoning, construction, or project guidance, but it is educational and general information, not legal, financial, engineering, architectural, or professional advice.

You are responsible for verifying requirements with qualified professionals and local authorities.

B. Feasibility Reports

The Rootd feasibility report is a professional planning deliverable prepared using available information at the time of work (including client-provided information and public/third-party sources). You may rely on the report to inform early decisions and conversations with an architect, engineer, builder, and/or permitting authority.

The report is not a permit approval, construction document set, or final engineering/architectural design. Final determinations are made by the Authority Having Jurisdiction (AHJ) and licensed professionals. You are responsible for confirming final requirements with the AHJ and your project team before committing to a budget or schedule.

9) Intellectual property

All content, materials, and branding are owned by Rootd or its licensors and protected by intellectual property laws. You may not copy, reproduce, or distribute materials except as explicitly allowed.

10) Limitation of liability

A. Source/assumption limits

We may rely on information from third parties (e.g., municipal records, GIS, zoning documents, utilities, survey/plot data, and client-provided materials). We aren’t responsible for errors or omissions in third-party or client-provided information.

B. Change + interpretation risk

Regulations, enforcement practices, and site conditions can change. Interpretations may differ between reviewers. Outcomes may vary even when projects are substantially similar.

C. Liability cap

To the maximum extent permitted by law, Rootd’s total liability arising out of the feasibility report or related services will not exceed the fees paid for the specific report/service giving rise to the claim. Rootd will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, delays, or financing impacts).

11) Disputes and chargebacks

If you have an issue, contact us first at hello@rootdmodular.com so we can try to resolve it. Unresolved chargebacks may result in refusal of future service.

12) Changes to these Terms

We may update these Terms occasionally. The “Last updated” date above indicates the latest version. Continued use of our Services after changes means you accept the updated Terms.
